1. Introduction

1.1 Thank you for choosing to visit the website of Tres Fashion Ltd. (the “Company” or “Tres”) at the address: https://TresTLV.com (the “Website”).
1.2 This Privacy Policy forms an integral part of the Website Terms and Conditions and constitutes a binding agreement between the Company and the users of the Website (each – a “User” and collectively – the “Users”) and customers who purchase on the Website (each – a “Customer” and collectively – the “Customers” or “you”).
1.3 The Company values its Users’ and Customers’ privacy and makes efforts to properly protect and preserve Users’ and Customers’ information. The purpose of this Privacy Policy is to help you understand how the Company uses the information provided to it by Users and Customers on the Website and/or collected by the Company during Users’ and Customers’ use of the Website and/or information which is saved in databases owned by the Company.
1.4 By accessing or using the Website and/or purchasing any products on the Website you agree to be bound by this Privacy Policy. If you do not agree to the terms of the Privacy Policy, in full or in part, please do not use the Website. 
1.5 Each User and Customer undertakes not to perform any illegal act with respect to the Company’s computer systems. In the event the Company will suspect any unauthorized use or illegal act in its computer systems, it will report such incident to the relevant authorities.
1.6 This Privacy Policy is addressed to all genders equally, but for convenience reasons only is worded in the feminine language.

2. Information Collected.

2.1 The Company may collect the following information regarding Users and Customers: (1) browsing data  about the devices you use to access the Website (desktop and mobile), for example your IP address and device type and location; (2) information provided voluntarily while creating a personal account on the Website or registering for the Company’s newsletter, such as the first name, last name, email address; (3) additional information provided voluntarily as part of the process of purchasing products on the Website, such as phone number, I.D., address, date of birth, and other identifying information that may be requested by the Company; and (4) information regarding Users’ and Customers’ search history, shopping habits and history, advertisements that Users and Customers have read, information about pages that Users and Customers have viewed, the offers they were interested in, and any other similar information, including, without limitation, “cookie” files (collectively – the “Information”).
2.2 The Information will be stored in the Company’s databases as long as it is needed to fulfill the purposes of the databases or as long as the Company deems it necessary. The Company will operate and manage its databases in accordance with applicable law. 
2.3 You hereby agree to the collection, storage, and processing of the Information in the Company’s databases for the purposes listed in this Privacy Policy.
2.4 In addition to the Information detailed in Section 2.1 above, when making a purchase on the Website, you may provide your credit card or PayPal details (the “Payment Details”), but the transaction will be carried out through external service providers (the “Payment Service Providers”), that will process the payments and collect the Payment Details in accordance with and subject to their own privacy policies. It is hereby clarified that the Company neither collects nor stores Payment Details of its Customers.
2.5 While making a purchase on the Website, please review the privacy policy of the applicable Payment Service Provider before providing your Payment Details.
2.6 It is hereby clarified that Users and Customers are not obliged to provide any Information or Payment Details to the Company or Payment Service Providers, but if they do not provide such Information or Payment Details they will not be able to benefit from some of the services offered by the Company.
2.7 Any Information and Payment Details provided by you for the purpose of creating a personal account on the Website, contacting the Company, registering for the Company’s newsletter, or making purchases on the Website, will be provided out of your own free will, without any obligation to provide any Information and Payment Details. When making a purchase on the Website, you will be required to confirm acceptance of the Website Terms and Conditions, of which this Privacy Policy is an integral part, and may also confirm your acceptance to receive advertisements, marketing materials and offers.

3. Use of Information.

3.1 The Information is collected by the Company for the purposes listed below: (1) to enable the Company to operate and manage its business activities and allow Users and Customers to use the services offered by it; (2) for the purpose of contacting Users and Customers and sending them various content, including advertisements, marketing materials, offers, newsletters, and direct mail, subject to Users’ and Customers’ consent to receive such content and subject to the fact that Users and Customers may request at any time not to receive such content; (3) for the purpose of personalizing Users’ and Customers’ preferences and topics of interest on the Website; (4) to improve and enhance the Company’s products and services and to create new services and content that match Users’ and Customers’ preferences, as well as to amend or cancel existing services; (5) for the purpose of analyzing statistical information and delivering the results thereof to third parties, including, without limitation, to the Company’s business partners; and (6) for any other purpose related to the Company’s products and services.
3.2 The Information will not be transferred to third parties without Users’ and Customers’ prior written consent, except as permitted in this Privacy Policy, as may be updated from time to time. Notwithstanding the foregoing, the Company may transfer the Information to third parties in the following situations: (1) the Information may be transferred to the Company’s service providers as required by the Company to provide its products and services to Users and Customers in accordance with the purposes detailed in Section 3.1 above, including to third parties that provide the Company with marketing and advertising services, online ad matching and the like, even if the Information will be used by such third parties for their related purposes; (2) the Information may be transferred to the Company’s business partners and/or other third parties for the purpose of business collaboration; (3) in the event of a violation of the Website Terms and Conditions and/or this Privacy Policy, the performance of any unlawful act, or an attempt to perform such acts by a User or Customer; (4) in the event the Company receives an order from a competent authority instructing it to disclose Information of a User or Customer to a third party; (5) in the event the Company deems that the provision of the Information is necessary to prevent damage to the body or property of a User or Customer or another person; and (6) the Company may transfer to third parties anonymized statistical information regarding the use of the Website.
3.3 The Company will oblige any third party to whom it provides the Information not to make any use of the Information except for the purposes specified above.
3.4 The Company is assisted by various third-party companies that provide statistical analyses about the Website’s use, the frequency of its use, Users’ and Customers’ access to the Website, and the like. The information thus collected is statistical in nature, does not identify the User or Customer personally and is intended for analysis, research, and control purposes.
3.5 The Company may disclose Information to third parties in case of a merger and/or transfer or sale of all or substantially all of the assets of the Company to a third party and/or to companies controlled by the Company and/or affiliated companies, insofar as the transfer of the Information will be required for the purpose of operating the Company’s business as stated, including in any case of a transfer of the operation and/or ownership of the Website.
3.6 The Information provided to Tres by Users and Customers will be stored in the Company’s databases only for the time required to fulfil the purposes for which the Information is collected, as will be deemed necessary by the Company at its sole discretion, and in any case – in accordance with applicable law. It is hereby clarified that anonymized information may remain on the Company’s servers indefinitely and the Company may use such information, among other things, for analytical and statistical purposes.

4. Data Security.

4.1 The Company has implemented appropriate technical and organizational security measures in order to secure the Information stored in its computer systems. Breaking into the Company’s computer systems constitutes a criminal offense under the laws of the State of Israel, punishable by up to five years of imprisonment. However, the Company cannot guarantee that its systems, services, and Website will be completely immune from unauthorized access to the Information stored therein and that a third party will not interfere with and/or penetrate and/or misuse the Information and/or perform any other illegal act, despite the safety precautions taken by the Company, and Tres will not be  liable for any damage of any kind that may be caused to Users’ and Customers’ Information as a result of such unauthorized access or use. Users and Customers hereby irrevocably waive any claim or demand of any kind against the Company and/or anyone on its behalf with respect to any damage that may be caused and/or is caused by any unauthorized access or use. 
4.2 The Company will not be liable if the username and password of a User or Customer who has created a personal account on the Website are used by someone who is not authorized thereto. Such information must be stored safely, and, in order to maintain a maximum level of security, the Company recommends that the password to the personal account be replaced periodically.

5. Other Websites.

The Website may include links to various pages, applications, and websites which are not managed and/or operated by the Company and/or anyone on its behalf. The Company does not control and/or supervise such pages, applications, and websites, and the fact that the Website may contain links to such content does not indicate Tres’ approval thereof and does not constitute a guarantee of the reliability, up-to-dateness, or legality of such content. The use of such pages, applications, and websites is subject to their own privacy policies and not to this Privacy Policy.

6. Use of “Cookies”.

6.1 The Website may use “cookies”, pixels and/or digital beacons (collectively – “Information Collection Tools”) to store information locally on Users’ and Customers’ devices or on remote servers in connection with the use of the Website. The purpose of the use of such Information Collection Tools is to make Users’ and Customers’ browsing experience on the Website simpler, more relevant, and convenient, including through the collection of statistical data about the use of the Website and by adapting the Website or its content to Users’ and Customers’ preferences, as well as to meet data protection requirements.
6.2 “Cookies” are text files created by the browser. Some “cookies” will be deleted when the browser is closed and some will be saved on the computer’s hard drive. “Cookies” contain a variety of data, such as information about the pages Users and Customers visit, the duration of Users’ and Customers’ visit on the Website, information about how Users and Customer were directed to the Website, etc. “Cookies” are also used to avoid the need to enter certain Information during every visit to the Website. The data in “cookies” is encrypted, and the Company takes precautions to ensure that its computers can read and understand the information stored therein.
6.3 The Company may allow third parties to place and manage advertisements on the Website. It is possible that the advertisements that will be displayed when Users and Customers visit the Website will originate from the computers of such third parties. In order to manage such advertisements, these third parties will be allowed to place “cookies” on Users’ and Customers’ devices. Such third parties’ use of “cookies” will be governed by their own privacy policies and not by this Privacy Policy.
6.4 You can block “cookies” by changing the settings in your browser (please contact your internet service provider for help), but please note that doing so may prevent us from delivering certain services to you.

7. Rights of Users and Customers.

7.1 Right to View and Access Information.

7.2 Right to Correction and Deletion of Information.
a. In case your Information is incorrect or incomplete, you may request the correction or deletion of such Information by contacting Tres as detailed in Section 7.1 above. 
b. You also have the right to delete the Information held by Tres and/or withdraw your consent to the collection, storage, use, and transfer of your Information. Absent exceptional circumstances (e.g. when we are required to store data for legal reasons), Tres will generally delete your Information and restrict the collection of your Information upon your request. However, please note that such a deletion and/or restriction may affect our ability to provide you, partly or entirely, with our services.

8. Changes to Privacy Policy.

8.1 The Company may update or amend this Privacy Policy from time to time, including as a result of technological, business, legal, or regulatory reasons. If substantial changes are made to this Privacy Policy as regards the use of the Information provided by Users and Customers, this Privacy Policy will be updated accordingly.
8.2 Any such change to the Privacy Policy will enter into force once it is published on the Website. It is the Users’ and Customers’ duty to keep up to date with any changes to this Privacy Policy. The Privacy Policy as published on the Website at a given moment is the applicable and binding version of the Privacy Policy.

9. Advertising Information.

9.1 The Company and/or anyone on its behalf and/or its business partners may send you “advertising materials”, as defined in Section 30a of the Israeli Communications Law (Bezek and Broadcasting) 5742-1982 (the “Communications Law”), and/or advertising and/or marketing materials of Tres and/or its business partners (collectively – the “Advertising Information”), through electronic messages, SMS messaging, or any other means of communication (provided you have not opted out of such communications). It is hereby clarified that Advertising Information may include advertisements, publications that accompany news content, or even content that is absent of any news content. 
9.2 You hereby consent that the Company and/or anyone on its behalf and/or its business partners will send you Advertising Information, including by means of electronic messages, SMS messaging, or any other means of communication. It is hereby clarified that in order to send a User or Customer content which is of interest to her or content regarding products and services that are most suitable for her, information about the User or Customer may be used as stated above.
9.3 You may notify the Company at any time of your wish to no longer receive Advertising Information by giving written notice to Tres and/or through the means in which the Advertising Information was delivered to you. Notwithstanding the foregoing, it is hereby clarified that the withdrawal of your consent to receive Advertising Information will not delete Information about you stored in the Company’s databases, and Tres will be entitled to continue using such Information in accordance with this Privacy Policy and the applicable law.

10. Miscellaneous.

10.1 The Company may assign and/or transfer, at its sole discretion, all or a part of its rights under this Privacy Policy to any company or other third party, without the need to provide advance notice.
10.2 This Privacy Policy is governed by the laws of the State of Israel. The courts in Tel Aviv-Jaffa will have exclusive jurisdiction with respect to any matter concerning this Privacy Policy.
10.3 If any provision of this Privacy Policy is found to be illegal, void, or unenforceable for any reason, such provision will be disregarded without affecting the legality or validity of the remaining provisions hereof.
